Terms of Use

These Terms of Use (hereinafter referred to as “these Terms”) set forth the terms and conditions for the use of the services (hereinafter referred to as “the Services”) provided on the online store (hereinafter referred to as “this Site”) operated by NOT CONVENTIONAL (hereinafter referred to as “the Store”).

Customers using the Services must review the contents of these Terms before using the Services.

Article 1 (Scope of Application)

These Terms apply to all customers who use this Site.

“Member” refers to a customer who uses a customer account on this Site in accordance with the methods prescribed by our Store.

“Member Information” refers to a member’s name, address, email address, order history, and other information pertaining to the member.

In addition to these Terms, customers shall comply with the Shopping Guide, Return and Refund Policy, and other terms and conditions for the use of the Services as separately established by our Store.

In the event of any conflict between these Terms and any separate terms of use, the separate terms of use shall take precedence unless otherwise specified.

Article 2 (Member Registration and Account Management)

Customers may use their accounts in accordance with the methods prescribed by our store.

Members shall accurately register and manage the information necessary for account use, such as their email address.

Members shall not disclose, lend, transfer, or share authentication codes or other authentication information used for login to third parties.

Members shall promptly contact the Store if there is a risk that their account has been misused by a third party.

The Store may restrict the use of an account in cases of registration using false information, unauthorized use, or other reasonable grounds.

Liability for damages arising from unauthorized use of an account or similar incidents shall be determined in accordance with applicable laws, based on the respective liability (if any) and degree of liability of the Store and the Member.

Article 3 (Changes to Registration Information)

Members shall promptly update their registered information—including name, address, phone number, email address, and other details—using the designated method whenever such information changes.

If errors in registered information or delays in updating such information cause disruptions to product delivery or other services, the matter shall be addressed based on the cause and the party responsible.

Orders confirmed prior to any changes to registered information may be processed based on the information prior to the change. If you wish to change the shipping address or make other changes after placing an order, please contact our store promptly.

Article 4 (Withdrawal from Membership)

If a member wishes to withdraw from membership, the member shall complete the withdrawal procedure in accordance with the method prescribed by the Store.

Upon completion of the withdrawal procedure, the member’s use of the services provided to members shall cease.

If, at the time of withdrawal, there are any orders that have not yet been shipped, unpaid balances, or other uncompleted transactions, the member shall continue to take the necessary actions regarding such transactions.

Personal information held after withdrawal will be handled in accordance with our Privacy Policy, except where there is a legal obligation to retain such information or other legitimate necessity.

Article 5 (Suspension of Use and Revocation of Membership)

If we reasonably determine that a member falls under any of the following items and that continued use of the account is inappropriate, we may take measures against such member, including restricting use, suspending use, or revoking membership.

(1) If there are material falsehoods in the registration information

(2) If the member fails to fulfill payment obligations, such as payment for merchandise, without just cause

(3) If fraudulent orders, unauthorized use of payment methods, or other fraudulent acts are confirmed

(4) In the event of a material breach of these Terms and Conditions

(5) In any other case where there are reasonable grounds equivalent to those listed in the preceding items

When taking the measures described in the preceding paragraph, we will endeavor to provide advance notice to the extent possible, except in cases of urgency or other unavoidable circumstances.

If we suffer damages due to a member’s intentional or negligent acts, we may seek compensation for damages in accordance with applicable laws and regulations.

Article 6 (Handling of Personal Information)

We will handle customers’ personal information appropriately in accordance with the Act on the Protection of Personal Information, other relevant laws and regulations, and our Privacy Policy.

We will use customers’ personal information within the scope of the purposes of use we have publicly disclosed, including product shipping, payment processing, responding to inquiries, and service improvement.

Except as permitted by law, we will not provide personal data to third parties without obtaining the prior consent of the individual concerned.

When we entrust the handling of personal information to contractors to the extent necessary for product delivery, payment processing, system operation, and other purposes, we will exercise appropriate supervision in accordance with applicable laws and regulations.

We may send information regarding new products, campaigns, and other matters to customers from whom we have obtained the necessary consent, in accordance with applicable laws and regulations, for the distribution of promotional emails and similar communications.

If you wish to opt out of receiving promotional emails and similar communications, you may do so by following the method specified by our store. However, this does not apply to communications necessary for transactions, such as order confirmations and shipping notifications.

Article 7 (Prohibited Acts)

When using this Service, customers must not engage in the following acts:

Acts that violate laws and regulations or these Terms of Service

Acts that infringe upon the rights, interests, reputation, or credibility of our store or third parties

Acts that violate public order and morals

Acts that cause disadvantage, damage, or inconvenience to other customers or third parties

Acts involving the registration or provision of false information

Ordering products or making payments through fraudulent means

Transmitting harmful programs or engaging in unauthorized access

Unauthorized use of another person’s account or authentication information

Use of images, text, designs, or other content posted on this website without the rights holder’s permission

Any other inappropriate acts equivalent to those listed in the preceding items

Article 8 (Purchase of Products)

Customers may purchase products on this website using the methods specified by us.

The sales price of products, shipping fees, payment methods, payment deadlines, delivery dates, and other terms and conditions of the transaction shall be governed by the information displayed on the product page, the purchase procedure screen, and the disclosures required under the Act on Specified Commercial Transactions.

A sales contract shall be deemed to be concluded at the time our store accepts the customer’s order.

If it becomes difficult to provide the products due to stock shortages, payment issues, material errors in product information, or other unavoidable circumstances, we may contact the customer and take appropriate measures, such as modifying the order or canceling the contract, in accordance with applicable laws and the terms of the contract.

If we cancel an order due to our own fault and a refund is required, we will issue the refund appropriately in accordance with applicable laws and the terms of the transaction.

Article 9 (Cancellations, Returns, Exchanges, and Refunds)

As a general rule, we do not accept cancellations, changes to order details, returns, or exchanges requested by the customer after an order has been confirmed.

We also do not generally accept returns or exchanges due to customer-related reasons, such as selecting the wrong size or color, the product not meeting expectations, or duplicate orders.

In cases of defective products, incorrect shipments, or other situations where our store bears legal liability, we will provide exchanges, refunds, or other appropriate remedies.

If a product is defective or was shipped incorrectly, please contact us within approximately 7 days of receipt, providing your order number and details regarding the product’s condition. Please note that even if this period has passed, this does not limit your rights under applicable laws.

We will cover the return shipping costs and the costs of reshipping for returns or exchanges resulting from our store’s responsibility.

In cases where a customer refuses delivery, is absent for an extended period, or returns an item without authorization, we may require the customer to bear the actual shipping costs and other expenses incurred, to the extent permitted by law.

Details regarding returns and refunds shall be governed by the separately established “Returns and Refunds Policy.” However, this does not limit the customer’s rights as recognized by law.

Article 10 (Interruption or Suspension of Service)

We may temporarily interrupt or suspend all or part of this Service in any of the following cases:

When performing system maintenance, inspections, updates, etc.

In the event of system failures, communication failures, excessive traffic, etc.

In the event of fire, power outages, natural disasters, or other force majeure events

In the event of unauthorized access or disruptive acts by third parties

In other cases where operational circumstances make it unavoidable

We will endeavor to provide advance notice whenever possible; however, in emergencies, we may suspend or discontinue the Service without prior notice.

Article 11 (Changes to and Termination of Services)

We may change, add to, or terminate the content of this Service.

We will endeavor to provide advance notice, by reasonable means and within a reasonable timeframe, of any changes or termination of the Service that would have a significant impact on customers.

With regard to sales contracts already in effect at the time of any change or termination, we will handle them appropriately in accordance with applicable laws and the terms of the relevant contract.

Article 12 (Intellectual Property Rights)

Copyrights, trademark rights, and other intellectual property rights pertaining to images, text, logos, designs, videos, and other content posted on this website belong to us or the legitimate rights holders.

Customers may not reproduce, reprint, modify, distribute, or use this content for commercial purposes beyond the scope permitted by law without the prior permission of the rights holder.

Article 13 (Disclaimer and Compensation for Damages)

While we strive to provide this service reliably and ensure the accuracy of the information, we do not guarantee that this service will be available at all times due to communication environment issues, system failures, or other circumstances.

With regard to damages arising from natural disasters, communication failures, or other causes not attributable to our store, liability shall be determined in accordance with applicable laws and regulations.

If a customer suffers damages due to causes attributable to our store, our store shall be liable in accordance with the Consumer Contract Act and other relevant laws and regulations.

No provision of these Terms shall exempt or unduly limit the liability that our store is required to bear under applicable laws and regulations.

Article 14 (Amendments to These Terms and Conditions)

We may amend these Terms and Conditions as necessary in accordance with applicable laws and regulations.

Amendments to these Terms and Conditions shall be made only to the extent that they satisfy the requirements set forth in Article 548-4 of the Civil Code and other applicable laws and regulations, such as when the amendment is in the general interest of customers, does not conflict with the purpose of the contract, and is reasonable in light of the necessity of the amendment, the appropriateness of its content, and other circumstances.

In the event of an amendment to these Terms, we will notify users of the amended terms and the effective date, among other details, by posting them on this website or through other appropriate means.

For amendments that require specific consent under applicable laws, we will obtain such consent through the prescribed procedures.

Article 15 (Governing Law and Jurisdiction)

These Terms and any agreements regarding the Service shall be governed by the laws of Japan. However, this shall not apply if otherwise provided by applicable laws and regulations.

In the event of any dispute arising from these Terms or the Service, the District Court or Summary Court having jurisdiction over the location of our head office shall be the agreed-upon court of first instance. However, this shall not preclude the jurisdiction of any other court permitted by law.
